Terms and Conditions

The terms and conditions contained in this document are those under which The Royal Mint  Limited (we) supply any of the products advertised from time to time or listed at our website www.royalmint.com and ordered by you (Products). Please read the terms and conditions carefully as they will form the basis of our contract with you. You should retain a copy of these terms and conditions for future reference.

We are committed to providing total quality service and high quality products.

1. Information about us

1.1 We are a government owned company.

1.2 The following information is required by the Electronic Commerce (EC Directive) Regulations 2002. www.royalmint.com is provided by The Royal Mint Limited whose registered
office is at Llantrisant, Pontyclun, CF72 8YT, United Kingdom (registered in England and Wales No. 06964873).

2. Supply

We reserve the right to refuse to supply any individual or company.

3. Your Status

By placing an order you warrant that:

(a) You are legally capable of entering into binding contracts; and

(b) You are at least 18 years old.

4. How the contract is formed between you and us

4.1 After placing an order via the website, you will receive an automated email from us acknowledging that we have received your order ('Acknowledgment'). This does not mean that your order has been accepted.

4.2 Your order constitutes an offer by you to us to buy a Product. We will confirm acceptance of your order by sending you further correspondence that confirms that the Product has been or shall be shortly despatched (the 'Despatch Confirmation'). The contract between us ('Contract') will only be formed when we send you the Despatch Confirmation, not when we send you the Acknowledgment.

4.3 The Contract will relate only to those Products whose dispatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other Products, which may have been part of your order until dispatch of such Products has been confirmed in a separate Despatch Confirmation. For the avoidance of doubt, the Despatch Confirmation will be sent to the address for the delivery of the order unless otherwise directed by you. You may request the Despatch Confirmation to be sent to you via email provided that you provide to us a valid email address at the time of order.

5. Availability and delivery

5.1 All Products are subject to availability and may be withdrawn at any time prior to us sending you a Despatch Confirmation in respect of Products already ordered.

5.2 We will endeavour to deliver within 21 days of the date of your order or the advertised delivery date, unless there are exceptional circumstances. If we are unable to deliver your order within 21 days we will notify you in writing of the delay. In the event of a delay in delivery you may cancel your order resulting in a full refund.

5.3 We reserve the right to change any packaging material used and to vary the costs of any packaging materials as may be reasonably necessary.

6. Risk and title

6.1 The Products will be at your risk from the time of receipt by you. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of any and all Products ordered by you from us:

a) which have been delivered; or

b) in respect of which a Despatch Confirmation has been issued to you.

7. Price and payment

7.1 Subject to the clause 7.2 below, the price of any Products purchased via our website will be as quoted on our website from time to time, except in cases of obvious error (being a manifest or clerical error/typographical error). Subject to clause 7.2 below, the price of any Products purchased via telephone or post will be as advertised from time to time (such prices correct at the time of printing), except in cases of obvious error (being a manifest or clerical error/typographical error). These prices include VAT but exclude delivery costs, which will be added to the total amount due as set out in our invoice. Delivery costs shall be as quoted on our website or advertisements (whichever is applicable) from time to time, except in cases of obvious error (being a manifest or clerical error/typographical error).

7.2 Prices are liable to change at any time because of fluctuations in raw material price and changes in delivery charges for example, but changes will not affect orders for any Products for which we have already sent you a Despatch Confirmation. If we need to make changes to prices and/or delivery charges, we will contact you using the contact details you provided to us to check whether you still wish to proceed with the order on the basis of the new prices/new delivery charges. No price variations will be applied retrospectively in respect of any orders for Products for which we have already sent you a Despatch Confirmation but we cannot honour any former advertised prices or delivery charges quoted on our website which have subsequently changed unless we have already issued you with a Despatch Confirmation in respect of those Products ordered by you.

7.3 You can pay for Products ordered via the website in full by credit or debit card.

7.4 You can pay for Products ordered by telephone or post:

a) in full by cheque (payable to Royal Mint) or credit or debit card (we will not charge your credit or debit card until we dispatch your order). Cheques are cashed on receipt; or

b) by instalments through a Royal Mint Interest Free Account. For more information on this Account please contact our Customer Services Team at PO Box 500, Pontyclun, CF72 8WP, telephone 0845 6088 300 or email at customer.services@royalmint.com. Interest free accounts are subject to status.

7.5 We will not charge your credit or debit card until we have allocated stock to your order. Where you have have ordered more than 1 Product you may request for part of your order to be despatched before the whole order is ready for despatch once 1 of the Products ordered is ready for despatch. You will be responsible for all and any additional delivery costs incurred as a result of your request for part delivery of orders. If the price of Products ordered does vary (as stated in clause 7.2 above) we will seek your agreement before deducting more than the previously quoted price.

8. Consumer rights

8.1 Subject to clause 8.3, if you are a consumer, you may cancel the Contract at any time within 30 working days beginning on the day after you received the Product(s). In this case, you will receive a full refund of the full original purchase price paid for the Products along with the delivery charges paid in accordance with our refunds policy (set out in clause 9). You will be responsible for the costs of returning the goods to us and this cannot be refunded unless the Products are confirmed by us to be damaged or sub-standard.

8.2 To cancel a Contract, you must inform us by writing to Quality Department, PCU PO Box 500, Pontyclun CF72 8BR. You must also return the Product(s) to us immediately by special delivery to the same address, in the same condition in which you received them, and at your own risk. You must take reasonable care of the Products while they are in your possession.

8.3 Notwithstanding clause 8.1 you wil not have any right to cancel a Contract for the supply of any Products which have been personalised.

9. Our refunds policy

9.1 When you return a Product to us:

(a) because you have cancelled the Contract between us within the 30 working day cooling-off period (see clause 8.1), we will process the refund due to you including all delivery charges within 30 days of the day you have given notice of your cancellation.

(b) because you claim that the Product is defective (including Products which have been personalised), we will examine the returned Product. If we agree that the Product is defective we will notify you of your refund by email or by post within a reasonable period of time. Products returned by you because of a defect will be refunded in full including all delivery charges.

(c) because you have relied on our 30 day buy back guarantee we will process the refund of the full original purchase price due to you within 30 days of receipt of the Product by us.

9.2 We will usually refund any money received from you using the same method originally used by you to pay for your purchase but we reserve the right to refund you by any other reasonable means.

9.4 Whilst Products are in your possession you are expected to take all reasonable care.

9.5 This provision does not affect your statutory rights.

10. Our liability

10.1 Subject to clause 10.2, we warrant to you that any Product purchased from us is of satisfactory quality and fit for all the purposes for which products of the kind are commonly supplied. Our liability for losses you suffer as a result of us breaching this Contract is strictly limited to the purchase price of the Product you purchased and we will not be responsible for indirect loss or consequential loss however arising and whether caused by tort (including negligence), breach of contract or otherwise.

10.2 Clause 10.1 does not include or limit in any way our liability to you:

(a) for death or personal injury caused by our negligence;

(b) For fraud or fraudulent misrepresentation; or

(c) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

11. Privacy

11.1 We keep the details you provide confidential and will use them to administer your order which may also include checking your details with any credit reference agency and to other persons for credit vetting, fraud prevention or debt collection purposes. From time to time we may keep you informed of information about other products and services that may be of interest to you. If you do not wish to receive information about other products and services that may be of interest to you, please let us know by e-mailing customer.services@royalmint.com or writing to PO Box 500, Pontyclun, CF72 8WP.

11.2 Any personally identifiable data about you which we collect will be treated by us in accordance with our privacy policy which can be found on our website at www.royalmint.com.

13. Notices

All notices given by you to us must be given to The Royal Mint at customer.services@royalmint.com or PO Box 500, Pontyclun, United Kingdom CF72 8WP. We may give notice to you at either the e-mail or postal address you provide to us when placing an order. Notice will be deemed received and properly served 24 hours after an e-mail is sent, or 3 days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

14. General

14.1 You may not assign the Contract or any part of it without our prior written consent.

14.2 Subject to clause 10.2, we will have no liability to you under these terms if we are prevented from, or delayed in, performing our obligations under these terms by anything outside our reasonable control including, but not limited to, strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks or the acts, decrees, legislation, regulations or restrictions of any government.

14.3 Failure or delay by us in enforcing or partially enforcing any provision of the Contract shall not be construed as a waiver of our rights under the Contract.

14.4 If any provision of these terms is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.

14.5 These terms and conditions represent the entire agreement between you and us in relation to the subject matter of any Contract.

14.6 A person who is not a party to this Contract shall not have any rights under or in connection with it by virtue of the Contracts (Rights of Third Parties) Act 1999, save that if the Royal Mint’s legal status as a department of the British Government changes, any rights we have may be assigned by us automatically to any successor body without restriction and any such successor body may exercise rights under the Contract as if it was a party to it.

14.7 We have the right to revise and amend these terms and conditions from time to time by posting revised terms and conditions on the website. The revised terms and conditions will apply in respect of any order for Products made 24 hours or more after we have posted them on our website. If you do not agree to our revised terms and conditions as posted on our website, please do not order Products from us.

14.8 This Contract will be governed by the laws of England and Wales. Any dispute arising from, or related to, this Contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.
